PLATFORM SERVICE DISCLAIMER
NOTICE TO ALL USERS: NOKOSAI is an online platform developed and maintained by an independent developer. The service is provided strictly "AS IS" e "AS AVAILABLE" without any warranties of any kind. By using NOKOSAI, you acknowledge and agree that technical issues, server maintenance, or system updates may occasionally result in service interruptions, software bugs, or the loss of account data, active sessions, or settings. You use this platform entirely at your own risk.

TERMS AND CONDITIONS

1. Jurisdiction and Governing Law

NOKOSAI is operated from Kerala, India. These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.

2. Age Restriction (18+)

You must be strictly 18 years of age or older to access or use NOKOSAI. By registering an account, you legally warrant that you meet this age requirement. Any account found to belong to a minor will be terminated immediately and permanently without notice.

3. Acceptable Use and Prohibited Content

NOKOSAI acts purely as an intermediary conduit for user communication. You are solely responsible for the content you transmit. You strictly agree NOT to use NOKOSAI to share, transmit, or promote:

    • Sexual content, pornography, or Child Sexual Abuse Material (CSAM).
    • Hate speech, racism, or discriminatory harassment.
    • Doxing, targeted harassment, or the sharing of non-consensual personal information.
    • Profanity intended to abuse or threaten others.
    • Any activity that violates the penal laws of India or your local jurisdiction.
4. Right to Terminate and IP Ban (Zero Tolerance)

The Developer reserves the absolute right to moderate the platform to ensure a safe environment. We may suspend, terminate, or completely wipe your account, and apply permanent IP bans at any time, for any reason, without prior notice, warning, or liability. If you violate the Acceptable Use policy, your access will be revoked immediately.

5. Ephemeral Messaging & Data Loss

NOKOSAI is designed as an ephemeral, real-time communication space. We do not guarantee the permanent delivery or retention of any message. Accounts or data may be reset or modified during server maintenance, technical migrations, or platform infrastructure updates.

6. Limitation of Liability

To the maximum extent permitted by law, the Developer of NOKOSAI shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the platform, the conduct of other users, or any data loss, hacks, or service downtime.

PRIVACY & DATA COLLECTION POLICY (DPDPA 2023 COMPLIANT)

1. The Minimal Data We Collect

We believe in privacy by design. NOKOSAI only collects the absolute minimum data required to keep the service functional and secure. We collect:

Chosen by you, used solely for identification on the platform.
🔑 Password
Securely hashed and salted; we cannot see your actual password.
🌐 IP Address
Collected automatically by our servers for security and network ban enforcement.
2. Why We Collect This Data

Under the DPDPA 2023, we must state the explicit purpose of data collection:

  • Username & Password: Used exclusively for authentication and account validation.
  • IP Address: Collected strictly for security, spam prevention, and enforcing network-level bans against users who violate our Terms of Service.
3. Zero Data Retention of Chats

NOKOSAI does not read, store, or back up your private communications. All real-time chat data is routed ephemerally through WebSockets. No messages are ever written to or retained in our database.

Because we do not store chat histories, we cannot recover deleted messages, nor can we produce chat logs for law enforcement, as the data simply does not exist on our servers.

4. Data Sharing

We do not sell, rent, or share your Username, Password hash, or IP address with any third-party marketers, data brokers, or analytics companies.

5. Your Rights (Account Deletion)

You have the right to request the deletion of your account at any time. Upon initiating account deletion, your Username and Password hash will be permanently purged from our authentication database. Note that IP addresses may be temporarily retained on ban lists to prevent malicious actors from returning to the platform.
